This document sets out the Terms and Conditions of Use for this website (www.bluesockshop.com) and for the purchasing of products through the same. It is very important that you carefully read both these Terms and Conditions as well as our Cookies Policy, Privacy Policy and Data Protection Policy.

The use of this website or making any orders through the same imply that you have given your consent to be bound by these Terms and Conditions and the Policies indicated above. This means that should you partly or wholly disagree with the contents of these documents, you must not continue to use the website or make any orders. It is also important that you remember that these Terms and Conditions and our Policies may undergo changes in the future, and so you should re-read them regularly or when making new orders.

Nevertheless, GEST CARRIS S.L. will make itself available and collaborate actively with the authorities and security forces in order to remove or block any contents that are in violation of Spanish or International laws, or contrary to morals or public order or which infringe the rights of third parties. The website has been designed, developed, revised and tested so that it operates correctly and in a suitable, continuous way 24 hours a day, 7 days a week, throughout the whole year. Please note that to make an order from BLUESOCK SHOP you must be 18 years of age or older.

The products offered are distributed in Spain (except for the Canary Islands, Ceuta and Melilla), the Member States of the European Union, Andorra, Saudi Arabia, Australia, Canada, China, the United Arab Emirates, USA, Iceland, Japan and Switzerland.

Private individuals who live in countries or territories other than those indicated above may only make orders through this website if the address where the order is to be delivered is in one of these countries or territories.

HOW TO BUY

Products can be bought from the website by following these steps:

  1. Select the item you wish to buy by clicking on it, or adding it to the shopping cart, either from the categories pages, from the main highlighted items page, or from the product page.
  2. The shopping cart will contain the selected item, together with its name, size, colour and price, in the corresponding currency (including tax). The indicated price does not include transportation, which will vary in price depending on where the order is to be delivered. You must then click on “Proceed to checkout”
  3. A screen will then be shown to start a user session, or to create a new account in order to make purchases.

It will be necessary to provide the personal details of the user. These details will be include din a database used to process the order and to facilitate making new purchases on this website. In our Privacy Policy you can verify how the personal details you provide will be treated, and how you may exercise the rights expressed in Organic Law 15/1999 on the Protection of Personal Data (LOPD). It is very important that the information you provide us with is as accurate as possible in order to prevent any confusion or incidents with your deliveries. We will also invite you to receive information and publications by e-mail relating to the CARRÍS HOTEL GROUP. Please note that deliveries cannot be made to military bases or PO boxes. You must fill in the minimum details that are required and the option to subscribe to the newsletter and to receive news from the website. During this step, the user’s account is created in the database.

  1. The user will be sent an e-mail confirming the details indicated above, together with their password. If the user does not receive the e-mail, they must get in touch with us.

  1. Confirmation of details (new and registered users). Further delivery or invoicing addresses may be added, or the existing addresses may be updated. Additional notes or comments can also be added with reference to the order. The form used to add extra addresses is the same one used for registration purposes.
  2. The user must then select the delivery method with the different costs to be added to the purchase price.
  3. After filling in the purchase order, and before providing final confirmation, the user will be presented with a summary of the order, identifying the selected product or products, the total price (with tax and delivery costs) with the corresponding breakdown and delivery details for the order. The user must then confirm the purchase order by clicking on the button marked “Proceed to checkout”.
  4. Purchases may be made using credit or debit cards (Visa, Visa Electron, MasterCard). Charges will be made online, i.e. in real time, using the payment gateway of the corresponding financial entity, once the details provided by the user have been verified as being correct.
  5. Once the transaction has been confirmed, the user will receive an e-mail indicating the order number. This number may be used at any time from a computer with internet access to follow up the order. This e-mail will expressly contain the confirmation of the order, with the address indicated by the user, a description of the order, and the personal details provided for the acknowledgement of receipt. If the user does not receive this e-mail, this may be due to a temporary communications error in the network, or an incorrectly written e-mail address. In any event, BLUESOCK SHOP recommends in this case that users should contact the Customer Service Department. Users will also be informed by e-mail that the product has been dispatched to the address indicated when the order was made.

AVAILABILITY OF PRODUCTS

Orders are subject to the availability of the selected products. Products currently held in stock will be indicated on selecting the product. If at the moment of issuing the order it is found that there is no stock in our physical warehouse, BLUESOCK SHOP will attempt to locate the item by other means. If it is not possible to locate the product by any other means, the customer will be informed immediately.

RIGHT TO CANCEL AN ORDER

BLUESOCK SHOP may reject or cancel any order or not accept a confirmed order for any of the following reasons:

  1. If a technical or typographic error has occurred in the identification of the product, its characteristics, its details (including the price) shown on the website at the moment of making the order.
  2. If the product is not available.
  3. When the security systems or measures implemented for this purpose indicate that the order may be fraudulent, false or unreal.
  4. When there is reasonable cause to believe that the user is a minor.
  5. When BLUESOCK SHOP has not been able to deliver the order to the address indicated in the order.

In the event of any rejection, cancellation or non-acceptance of an order, BLUESOCK SHOP will fully reimburse any amounts that have been paid.

PRICE AND PAYMENT

Currency

The prices shown on this website are in Euros.

BLUESOCK SHOP may modify these prices at any time, although any such modification will not affect orders that have already been confirmed by means of delivery of the Order Confirmation e-mail.

Value Added Tax

GEST CARRÍS, S.L. will include the corresponding Value Added Tax (VAT) in the price of all orders as required by Spanish law.

Means of payment

Payment will only be accepted by credit or debit card (Visa, Visa Electron, MasterCard).

Charges will be made online, i.e. in real time, using the payment gateway of the corresponding financial entity, once the details provided by the user have been verified as being correct.

Security measures for payment

The security measures used will be those defined by the financial entities that manage the payment process.

In order to collaborate in the prevention of internet fraud, GEST CARRÍS, S.L. reserves the right to verify the personal details provided by the customer, as well as to adopt the measures established by applicable law or by the competent authorities, or which it may consider opportune, including the cancellation of the order, so that the goods acquired are delivered in compliance with the details shown on the order form, and so that all payments are made in a correct and suitable manner.

SECURITY: The website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorized access of data. To achieve these ends, the user / client accepts that the provider obtains data for the effect of the corresponding authentication of the access controls.

Any contracting process or involving the introduction of personal data will always be transmitted through secure communication protocol (HTTPS: //) in such a way that no third party has access to information transmitted electronically.

Limitations to purchasing

Purchases may not be made from this website that exceed 500 euros in total or which contain more than 20 items. These limits apply to each user and physical customer. If a customer is interested in making purchases that exceed these limits, they must contact the company using the tab marked CONTACT where they will be informed about the alternatives and options available for making purchases in excess of the established limits and quantities.

DELIVERY OF ORDERS

Orders made from the website www.bluesockshop.com will be delivered by post, within an approximate period of 10 working days in the case of deliveries to the Iberian Peninsula, and 20 working days in the case of other destinations. The cost of delivery to the customer’s home address will depend on its destination. The prices applicable to different destinations for deliveries are indicated below.

Delivery costs may be modified at any moment without prior notification.

Please remember that in order to prevent problems with delivery (wrong addresses, nobody at home, etc.), you must make every effort to ensure your details are correct, and fill in the corresponding form correctly. We would recommend filling in the box with a contact telephone number, which will allow us to solve any problems as quickly as possible and adapt ourselves to your availability.

Apart from the information you will receive by e-mail, whenever you want information about the status of your order you may CONTACT us, and we will quickly inform you about its location.

IMPOSSIBILITY OF DELIVERY

If it is impossible for us to deliver your order after making all of the necessary efforts, we will try to find a safe place to leave it where you can pick it up. If this is still not possible, the order will be returned to our warehouse and we will inform you by e-mail where the order is, and how to arrange for it to be delivered again.

If after FOURTEEN (14) days from your order being available for delivery, or if it cannot be delivered for causes that are not attributable to BLUESOCK SHOP, we will consider that you intend to withdraw from the contract, and we will consider it as terminated. Termination of the contract will entail the return of all payments you may have made to us, including delivery costs, with the exception of any additional costs that may have arisen as a result of selecting a different delivery method to the least expensive ordinary delivery method that we have offered you, without any undue delay, and in event within a maximum of FOURTEEN (14) days from the date when we consider the contract as having been terminated. Also, please note that the transportation resulting from the return may have an additional cost and that we may charge this to you (Law on the Defence of Consumers, Articles 102 and following of Royal Legislative Decree 1/2007).

BLUESOCK SHOP makes every effort to ensure that the information contained on the website is complete, accurate and correct. Should any errors be found, these will be corrected immediately.

The guarantee for the products offered for sale by BLUESOCK SHOP on this website is as defined in Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users.

BLUESOCK SHOP will respond to any lack of compliance by the products arising within two years from the date of delivery. Products will be considered as complying with the contract providing they correspond to the description of the product and the qualities indicated on this website, if they are suitable for the ordinary uses of products of the same type, and if they have the usual quality and performance of a product of the same type that an average consumer may expect. If any of the products are found to not comply with this requirement, you may inform us using the means of communication indicated in CONTACT.

Artisanal products may feature the characteristics of the natural materials used in their manufacture. These characteristics, such as variations in the absorption of dyes by glasses with wooden frames, or damage to the cloth used to make bags from recycled ship sails, in the knots and colour, will not be considered as faults or defects.

Exchange and returns policy

Exchanges, returns, refunds and cancellations

If after receiving your purchase you are not satisfied, you may change the size of the item acquired or return it (see below) within a period of FOURTEEN (14) days from the day on which the order was received, providing the item has not been used, washed or damaged. BLUESOCK SHOP will not accept returns or exchanges of items that have been used, washed or damaged, except for faulty items. For hygiene reasons, glasses cannot be exchanged or returned. Only exchanges for different sizes will be accepted, not for other different models. In order exchange a model or item for another, this must be processed as a return (see below) and a new purchase.

Any items being returned must be carefully packaged. The package must include the delivery note or the refund form, which must be correctly filled in.

Exchanges with home collection service

In order to change the size of products purchased from this website, you must send an application online via CONTACT sending an e-mail indicating the exchange you wish to make. We will contact you as soon as possible with the following return instructions. Once your request has been confirmed, we will contact you to arrange the collection date and time.

You should return the items using certified mail or with acknowledgement of receipt. All delivery costs for items you wish to change or return will be charged to the customer. BLUESOCK SHOP will not accept any returns received on a cash on delivery basis.

Right to withdraw

You have the right to withdraw from this contract without any need for justification within a period of FOURTEEN (14) calendar days from the date when you or any third party you may have appointed for this purpose, other than the courier, took physical possession of the items. The right to withdraw will be extinguished 14 calendar days after the customer acquires the goods. The item must not be used, washed or damaged. BLUESOCK SHOP will not accept any returns of used, washed or damaged items, except for faulty items. For hygiene reasons, glasses cannot be exchanged or returned.

Any items being returned must be carefully packaged. The package must include the delivery note or the refund form, which must be correctly filled in.

Return of items and refunds

In the event of withdrawing from the contract of sale, we will refund you all payments that you have made to use, including delivery costs, with the exception of any additional costs that may have arisen as a result of selecting a different delivery method to the least expensive ordinary delivery method that we have offered you. Also, please note that the transportation resulting from the return may have an additional cost and that we may charge this to you.

We will make the refund by using the same means of payment used to purchase the item(s). You will not be charged any additional amounts as a result of this refund.

You must return or directly deliver the item(s) without any undue delay, and in any event within a maximum period of FOURTEEN (14) calendar days from the date when you have informed us of your decision to withdraw from the contract. You will be considered as having complied with this period if you return the item(s) to us within this 14-day period. We may withhold the refund until the items have been received, or until you have presented us with proof of having returned the same.

Refunds

Once the product being returned has been received, BLUESOCK SHOP will check that it is in good condition, and then proceed to refund the amount paid by using the same payment method used when it was purchased. The refund period will vary between THREE (3) and TWELVE (12) working days from reception of the return at the warehouse of BLUESOCK SHOP.

In the event of exercising your right to withdraw from the order, the maximum period for returning the amount paid by the consumer for the products will be 30 calendar days from the moment we receive the product.

If the return is due to an error on the part of BLUESOCK SHOP by mistakenly sending an item other to that which has been requested or with an unsuitable quality, once the error has been verified, the amount paid for the item will be refunded together with the delivery costs.

PERSONAL DETAILS

All personal details provided by customers during the registration and processing of orders will only be used by GEST CARRÍS, S.L. for the purpose of processing orders and to facilitate browsing and the purchasing process on the website. If you expressly authorise us to do so, we will send you e-mails to inform you about new collections and exclusive offers.

GEST CARRÍS, S.L. guarantees that the details provided by its customers will not be shared with third parties or companies outside of the CARRIS Group.
